If you are a tenant facing eviction in Shasta County, or is your are a property owner attempting to evict a tenant, beware of Thomas Smith Jr. , Attorney in Wells, Selke and Small. In our case there were egregious babitablity violations. At trial, the landlady admitted these violations had occurred since we moved in and we won every legal point. In spite of this, lawyer Smith seemed to have a cozy understanding with the Judge, because the Judge diminished the claims we had against the landlady to almost nothing and sent the Sheriff to throw us out! Apparently, in Shasta County, the tenant always loses.
Lawyer Smith was derelict in his duty even to his own client. He was sloppy when serving eviction notices, he ignored and actually changed the Judge’s ruling that was in his client’s favor so it read against her, he neglected to inform her about her legal duty to account for the Security Deposit. Don’t hire him either way, as a landlord or as a tenant.
